클릭구조에 대한 특허는 특허권 사용료를 지불하고 합법적으로 사용하지 않게 되면, 제조업체, 유통업체 심지어는 소매업체까지 모두 법적 책임을 지게 되는 절대적인 법적 보호를 받게 되어 있습니다.

페르고는 세계적으로 뿐만 아니라 국내에서도 마루 바닥재 및 벽 패널의 클릭구조에 대한 특허를 업계 최초로 획득하였고(특허 제0424871호), 기술력과 특허권으로 첨단의 기술을 보호 받고 있습니다.

그러나 대부분의 중국 강화마루 제조업체는 이러한 특허 사용권이 없는 상태에서 클릭마루를 생산하고 있는 실정이며, 국내로 수입될 경우 유통업체는 일차적으로 특허권 위반에 직면하게 됩니다. 이는 심각한 법적인 문제를 야기할 뿐만 아니라, 이러한 특허분쟁이 확대될 경우 대리점은 물론 소매업체도 법적인 책임에서 벗어나기 힘들어 업계에 심각한 상황이 우려됩니다.

2/09/2005 - Flooring Industries adds Hansol and QDM to the I.T.C. case.

On the 2nd of September 2005 Flooring Industries has extended its complaint before the International Trade Commission. The complaint is now also directed against the Chinese company QDM and the South Korean company Hansol. Further Flooring Industries has amended the complaint so that it now also includes the recently granted so-called “clearances” patent US 6,928,779.

On the 29th of July 2005, the U.S. International Trade Commission (ITC) has voted to institute an investigation into the importation of wood and laminate floor in the United States that infringe the US patents owned by the Unilin Group.

The ITC has identified the following manufacturers, importers, distributors and/or resellers as respondents in this investigation:

Once the ITC has made its final determination whether the flooring panels of these respondents infringe Unilin’s US patents, an exclusion and cease and desist order for each infringing company shall be issued.

 
In the meantime, the Unilin Group continues to investigate the market closely to safeguard its intellectual property rights.
